QUOTATIONS AND ACCEPTANCES:
All proposals and acceptances of orders are made with the mutual understanding that orders are not subject to cancellation. The shipping date is approximated only by strikes, fires, or other causes beyond our control.

WARRANTY:
Any machine mechanically unsatisfactory may be returned within thirty (30) days from shipment, freight prepaid by purchaser, for full refund of purchase price. This does not apply to machines sold “AS IS”.

TERMS:
It is understood that there are no conditions or agreements outside of this written proposal and that all prior conversations, agreements, or representations with reference to its subject matter are superseded. Care is taken to give reliable descriptions but these are not guaranteed and prospective purchasers are advised to check vital details. We reserve the right to correct stenographic errors.

TITLE:
Title shall not pass to purchaser with delivery of the above personal property, but shall remain vested in seller until the entire purchase price is paid in full.

CLAIMS-CREDIT:
All claims for errors must be made immediately upon receipt of goods. No credit allowed on goods returned without our permission.

MACHINE SAFETY:
It is the user’s responsibility to provide safety devices and equipment to safeguard the operator from harm for any particular use, operation, or set-up, and to adequately safeguard the machine(s) to conform to all FEDERAL, STATE, AND LOCAL GOVERNMENT SAFETY STANDARDS AND ALL INDUSTRY SAFETY STANDARDS.

INDEMNIFICATIONS:
User agrees to indemnify and hold harmless seller from any and all claims or liabilities from accidents involving these machines caused by failure of users, his employees, or agents to follow instructions, warnings, or recommendations furnished by the manufacturer or seller, or by failure of user to comply with federal, state, and local laws applicable to such equipment including the Occupational Safety and Health Act of 1970 as amended. User shall notify seller promptly of any accidents involving these machines and in any event within thirty days after occurrence, and shall cooperate fully with the seller, or seller’s agent, in investigating and determining the cause of said accident.
